{"id":36950,"date":"2025-04-11T22:21:07","date_gmt":"2025-04-12T03:21:07","guid":{"rendered":"https:\/\/panamaadvisoryinternationalgroup.com\/blog\/?p=36950"},"modified":"2025-04-11T22:21:08","modified_gmt":"2025-04-12T03:21:08","slug":"panama-detected-multi-million-dollar-breaches-by-the-chinese-company-that-operates-two-key-ports-at-the-entrances-to-the-canal","status":"publish","type":"post","link":"https:\/\/panamaadvisoryinternationalgroup.com\/blog\/panama-detected-multi-million-dollar-breaches-by-the-chinese-company-that-operates-two-key-ports-at-the-entrances-to-the-canal\/","title":{"rendered":"Panama detected multi-million dollar breaches by the Chinese company that operates two key ports at the entrances to the Canal."},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The\u00a0<strong>Comptroller General of Panama<\/strong>,\u00a0<strong>Anel Flores<\/strong>, said on Monday that the audit carried out on the company\u00a0<strong>Panama Ports Company (PPC),\u00a0<\/strong>a subsidiary of the Hong Kong multinational\u00a0<strong>CK Hutchison<\/strong>, revealed multiple contractual breaches, a million-dollar debt with the Panamanian State and legal irregularities in the automatic renewal of its concession to operate two key ports at the entrances of the\u00a0<strong>Panama Canal<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;<strong>More than 300 million dollars that they owe us for breaches of contract<\/strong>,&#8221; Flores said during a press conference, referring to PPC, which manages the ports of&nbsp;<strong>Balboa&nbsp;<\/strong>and&nbsp;<strong>Crist\u00f3bal<\/strong>, located respectively on the Pacific and Atlantic coast of the canal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The company has been managing both ports since 1997,&nbsp;after obtaining a&nbsp;<strong>25-year&nbsp;<\/strong>concession contract, which was&nbsp;<strong>automatically renewed&nbsp;<\/strong>in June&nbsp;<strong>2021&nbsp;<\/strong>for a new equivalent period. This extension was concretized in the midst of public complaints about alleged&nbsp;<strong>corruption&nbsp;<\/strong>and&nbsp;<strong>unfavorable&nbsp;<\/strong>conditions&nbsp;<strong>for the State<\/strong>, which has only&nbsp;<strong>10% of shareholding&nbsp;<\/strong>in PPC.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the Comptroller&#8217;s Office, the original contract was modified in 2002,&nbsp;during the government of&nbsp;<strong>Mireya Moscoso (1999-2004),&nbsp;<\/strong>eliminating an annual fee of&nbsp;<strong>22 million dollars&nbsp;<\/strong>to the tax authorities and establishing as the only source of income for the State a charge for the movement of containers, in addition to granting extensive tax exemptions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Flores estimated that these conditions have meant a cumulative loss for the public treasury of approximately&nbsp;<strong>1.2 billion dollars<\/strong>, at a rate of&nbsp;<strong>55 million per year<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Flores also indicated that the\u00a0<strong>automatic renewal\u00a0<\/strong>of the concession was approved by the\u00a0<strong>Board of Directors of the Maritime Authority of Panama (AMP)\u00a0<\/strong>without complying with the legal requirements or having the\u00a0<strong>mandatory endorsement of the Comptroller General&#8217;s General&#8217;s State<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The official announced that a criminal complaint will be filed with the&nbsp;<strong>Public Ministry&nbsp;<\/strong>against the members of that board of directors and against PPC officers, with the aim of clarifying the conditions of a renewal that, in his words, was &#8220;excessively benevolent.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case has gained geopolitical relevance after statements by the President of&nbsp;<strong>the United States<\/strong>,&nbsp;<strong>Donald Trump<\/strong>, who assured that his government is &#8220;retaking back&#8221; control of the interoceanic route by stating that &#8220;China is operating the canal,&#8221; in reference to the presence of CK Hutchison in the ports of entry and exit of it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In that context, Trump celebrated as an achievement the announcement of a transfer agreement of the port concession between CK Hutchison and a consortium led by the US asset manager&nbsp;<strong>BlackRock<\/strong>, within the framework of a global operation that covers more than&nbsp;<strong>40 terminals&nbsp;<\/strong>in about&nbsp;<strong>20 countries<\/strong>, valued at almost&nbsp;<strong>23 billion dollars<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Panamanian President\u00a0<strong>Jos\u00e9 Ra\u00fal Mulino\u00a0<\/strong>again denied the statements of the US president and reaffirmed national sovereignty over the interoceanic route: &#8220;President Trump is lying again! The\u00a0<strong>Panama Canal\u00a0<\/strong>is not in the process of recovery. The channel is Panamanian and will continue to be Panamanian.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The transaction between CK Hutchison and BlackRock, which included the ports of Balboa and Crist\u00f3bal, was scheduled to take place on\u00a0<strong>April 2<\/strong>, but has been delayed due to an ongoing investigation by the\u00a0<strong>Chinese regulator<\/strong>, which has
