The creation of the 1,600-square-kilometer (620-square-mile)\u00a0<em>comarca<\/em>, as it\u2019s called in Panama, came as a result of a recent decision by the country\u2019s Supreme Court recognizing the Indigenous nation\u2019s land rights.<\/p>\n<p>The court\u2019s decision rested in part on evidence of the role that Indigenous groups play in protecting the environment in Panama, as has been shown elsewhere on the planet, according to an\u00a0<a href=\"https:\/\/www.ciel.org\/panamas-supreme-court-recognizes-indigenous-peoples-land-rights-and-role-as-guardians-of-the-environment\/\" target=\"_blank\" rel=\"external noopener noreferrer\" data-wpel-link=\"external\">analysis<\/a>\u00a0by the Washington, D.C.-based nonprofit\u00a0<a href=\"https:\/\/www.ciel.org\/\" target=\"_blank\" rel=\"external noopener noreferrer\" data-wpel-link=\"external\">Center for International Environmental Law<\/a>\u00a0(CIEL).<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/imgs.mongabay.com\/wp-content\/uploads\/sites\/20\/2021\/02\/17104047\/image003.jpg\" alt=\"The Naso celebrating the Supreme Court\u2019s decision allowing the creation of their comarca. Image courtesy of the National Coordinator of Indigenous Peoples in Panama (COONAPIP).<\/figcaption><\/figure>\n<p>Leaders in the Naso community have been working toward the goal of a comarca for decades, seeing it as a bulwark against potentially destructive outside incursions.<\/p>\n<p>\u201cHaving that official recognition of their land is so fundamental to their well-being and survival as a group,\u201d Sarah Dorman, a staff attorney with CIEL, told Mongabay.<\/p>\n<p>The Naso nation comprises around 4,000 people living in the rainforests of northern Panama along the Teribe River, territory they have lived in for generations. Butler\/Mongabay.<\/figcaption><\/figure>\n<p>Change appeared to be coming in 2018, when Panama\u2019s National Assembly passed a law to establish the Naso Tj\u00ebr Di Comarca. Shortly after the vote on the legislation, though, then-President Juan Carlos Varela vetoed it. He said the comarca would overlap with two protected areas designated in the mid-2000s: La Amistad International Park and Palo Seco Protected Forest, both UNESCO World Heritage Sites. As a result, he argued, the legislation creating the comarca was \u201cinconvenient,\u201d \u201cunenforceable\u201d and unconstitutional.<\/p>\n<p>In response, the legislature overrode Varela\u2019s veto, triggering a review of the matter by the Panamanian Supreme Court. The court rejected Varela\u2019s arguments on Nov. 12, 2020, ruling that the Constitution required that the government secure continued collective access for Panama\u2019s Indigenous people to their ancestral lands.<\/p>\n<p>The ruling notes that \u201cthe Indigenous population has preserved the environment in the places where they have settled, because they are bearers of ancient knowledge about biodiversity, plants, animals, water, and climate that allows for the sustainable use of the resources available to them,\u201d according to a translation from CIEL.<\/p>\n<figure id=\"attachment_239677\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-239677\" src=\"https:\/\/imgs.mongabay.com\/wp-content\/uploads\/sites\/20\/2021\/02\/17104031\/Alexis-Santana-Rey-del-pueblo-Naso-2-scaled-1.jpg\" sizes=\"auto, (max-width: 768px) 100vw, 768px\" srcset=\"https:\/\/imgs.mongabay.com\/wp-content\/uploads\/sites\/20\/2021\/02\/17104031\/Alexis-Santana-Rey-del-pueblo-Naso-2-scaled-1.jpg 768w, https:\/\/imgs.mongabay.com\/wp-content\/uploads\/sites\/20\/2021\/02\/17104031\/Alexis-Santana-Rey-del-pueblo-Naso-2-scaled-1-610x407.jpg 610w\" alt=\"Reynaldo Santana, the king of the Naso, speaks to a crowd. Image courtesy of the National Coordinator of Indigenous Peoples in Panama (COONAPIP).<\/figcaption><\/figure>\n<p>In another \u201ckey reference,\u201d according to Dorman, the court\u2019s members also wrote that Indigenous \u201claws, customs, and traditional practices reflect both an attachment to the land and the responsibility to conserve it for the use of future generations.\u201d<\/p>\n<p>In a\u00a0<a href=\"https:\/\/rainforestfoundation.org\/the-naso-people-of-panama-celebrate-land-rights-win-after-a-50-year-struggle\/\" target=\"_blank\" rel=\"external noopener noreferrer\" data-wpel-link=\"external\">statement<\/a>\u00a0following the ruling, the NGO Rainforest Foundation US said its analysis found that less deforestation had occurred on Naso lands than in the Palo Seco Protected Forest.<\/p>\n<p>\u201cAs the court says itself, Indigenous peoples are among the best protectors of the environment,\u201d CIEL\u2019s Dorman said.<\/p>\n<p>The court\u2019s decision extended the thrust of a legal memo issued by the Panamanian Ministry of Environment in 2019, saying that protected areas weren\u2019t an impediment to Indigenous land titling.<\/p>\n<figure id=\"attachment_239682\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-239682\" src=\"https:\/\/imgs.mongabay.com\/wp-content\/uploads\/sites\/20\/2021\/02\/17104057\/pan01-0707.jpg\" alt=\"Looking up at the canopy in Panama\u2019s rainforest. Butler\/Mongabay.<\/figcaption><\/figure>\n<p>The Naso Tj\u00ebr Di Comarca became official on Dec. 4, 2020, when Panama\u2019s current president, Laurentino Cortizo Cohen, went to the town of Sieyik, where the Naso\u2019s king resides, to sign the legislation. In a speech, Cortizo Cohen said the overlap between the comarca and the protected areas would ensure that the forests in the area would be doubly protected, according to a government\u00a0<a href=\"https:\/\/www.presidencia.gob.pa\/Noticias\/Presidente-Cortizo-sanciona-ley-que-crea-la-comarca-Naso-Tjer-Di-\" target=\"_blank\" rel=\"external noopener noreferrer\" data-wpel-link=\"external\">statement<\/a>.<\/p>\n<p>Dorman said the recognition of the Naso\u2019s territory is \u201chuge\u201d from a legal perspective. But she also said that more remained to be done to secure their forests.<\/p>\n<p>CIEL works closely with the Ng\u00e4be and Bugl\u00e9 Indigenous peoples in Panama, and these groups achieved a joint comarca in 1997. Dorman said that once a comarca is formed, the law requires demarcating the boundaries between a comarca and adjacent areas within two years.<\/p>\n<p>\u201cThat has not been finished to this day,\u201d she said.<\/p>\n<p>In the years since, Ng\u00e4be and Bugl\u00e9 community leaders say they\u2019ve been sidelined for development projects, most recently the\u00a0<a href=\"https:\/\/www.ciel.org\/news\/ngabe-bugle-and-campesinos-indigenous-peoples-declare-we-have-not-granted-our-prior-consent-for-panamas-fourth-transmission-line-in-a-statement-before-the-united-nations\/\" target=\"_blank\" rel=\"external noopener noreferrer\" data-wpel-link=\"external\">construction<\/a>\u00a0of a power transmission line through their territory that they worry will force them from their homes.<\/p>\n<figure id=\"attachment_239684\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-239684\" src=\"https:\/\/imgs.mongabay.com\/wp-content\/uploads\/sites\/20\/2021\/02\/17104108\/panama_0251.jpg\" sizes=\"auto, (max-width: 768px) 100vw, 768px\" srcset=\"https:\/\/imgs.mongabay.com\/wp-content\/uploads\/sites\/20\/2021\/02\/17104108\/panama_0251.jpg 768w, https:\/\/imgs.mongabay.com\/wp-content\/uploads\/sites\/20\/2021\/02\/17104108\/panama_0251-610x407.jpg 610w\" alt=\"An agouti, a rodent found in Panama. Butler\/Mongabay.<\/figcaption><\/figure>\n<p>The Naso have faced their own spate of development projects affecting their lands and fissuring their community. After years of construction on a tributary of the Teribe River, the Bonyik hydroelectric dam came online in 2014, and its social impacts reportedly rippled through Naso communities, according to a World Bank\u00a0<a href=\"https:\/\/www.inspectionpanel.org\/sites\/www.inspectionpanel.org\/files\/ip\/PanelCases\/53-Investigation%20Report%20%28English%29.pdf\" target=\"_blank\" rel=\"external noopener noreferrer\" data-wpel-link=\"external\">investigation<\/a>\u00a0as well as a 2014\u00a0<a href=\"https:\/\/undocs.org\/Home\/Mobile?FinalSymbol=A%2FHRC%2F27%2F52%2FAdd.1&amp;Language=E&amp;DeviceType=Desktop\" target=\"_blank\" rel=\"external noopener noreferrer\" data-wpel-link=\"external\">report<\/a>\u00a0by James Anaya, then the U.N. Special Rapporteur on the Rights of Indigenous Peoples. The dam also lies within the boundaries of the Palo Seco Protected Forest. In fact, human rights groups and Indigenous communities have expressed concern that such protected areas may in fact be a tool to dispossess Indigenous groups like the Naso of their lands to pave the way for lucrative development projects.<\/p>\n<p>Today, the Naso have recognition of their land rights, predicated on their ancestral claims and backed by evidence that shows the group\u2019s superlative environmental stewardship. But until the borders are established, they are still vulnerable from a legal standpoint, Dorman said.<\/p>\n<p>\u201cIf your land is not delineated completely,\u201d she said, \u201cit\u2019s just so much harder to legally defend against these outside encroachments.\u201d<\/p>\n<p><em>Banner image of a Panamanian golden toad by Rhett A.
