{"id":13513,"date":"2015-06-02T11:05:34","date_gmt":"2015-06-02T16:05:34","guid":{"rendered":"http:\/\/panamaadvisoryinternationalgroup.com\/blog\/?p=13513"},"modified":"2015-06-02T11:05:34","modified_gmt":"2015-06-02T16:05:34","slug":"filing-deadline-for-us-owners-of-foreign-corporations","status":"publish","type":"post","link":"https:\/\/panamaadvisoryinternationalgroup.com\/blog\/filing-deadline-for-us-owners-of-foreign-corporations\/","title":{"rendered":"Filing deadline for US owners of Foreign Corporations"},"content":{"rendered":"<p><a href=\"http:\/\/panamaadvisoryinternationalgroup.com\/blog\/wp-content\/uploads\/2015\/06\/depatment-of-commerce.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone  wp-image-13514\" src=\"http:\/\/panamaadvisoryinternationalgroup.com\/blog\/wp-content\/uploads\/2015\/06\/depatment-of-commerce.jpg\" alt=\"depatment of commerce\" width=\"693\" height=\"244\" srcset=\"https:\/\/panamaadvisoryinternationalgroup.com\/blog\/wp-content\/uploads\/2015\/06\/depatment-of-commerce.jpg 722w, https:\/\/panamaadvisoryinternationalgroup.com\/blog\/wp-content\/uploads\/2015\/06\/depatment-of-commerce-300x106.jpg 300w\" sizes=\"auto, (max-width: 693px) 100vw, 693px\" \/><\/a><\/p>\n<p>I got a call from my CPA on the 29th of last month telling me that I had a day to file a report with the Department of Commerce or face penalties and possible jail time!!\u00a0 Ok, after catching my breath and looking inot this further, I realized that my government has just passed more legislation that makes me want to give up my citizenship.\u00a0 Simon Black came out with a piece that talks about how absurd this is getting.<\/p>\n<p>Chances are that you\u2019ve never heard of the International Investment and Trade in Services Survey Act that was originally passed nearly 40 years ago.<br \/>\nAnd chances are you didn\u2019t catch the November 20, 2014 edition of the \u2018Federal Register\u2019, the US government\u2019s daily opus of new rules and regulations that ran 331 pages that day.<br \/>\nSo, chances are, you have no idea that the Department of Commerce might just want to throw you in jail right now. I\u2019ll explain.<br \/>\nBack in 1976, Congress decided that they needed more information on US companies\u2019 international trade activities.<br \/>\nSo they passed a law requiring the Department of Commerce to survey the biggest businesses in America to find out more about what they were doing abroad.<br \/>\nThese days, the survey is conducted every five years. And like most surveys it\u2019s a bunch of useless bureaucratic drivel that only wastes the time of the poor souls who have to fill it out.<br \/>\nNow it\u2019s something that can get you thrown in jail.<br \/>\nLate last year the Commerce Department quietly published a new \u2018rule\u2019 in the Federal Register requiring every American with certain investments abroad to fill out their survey, regardless of whether or not they were notified.<br \/>\nIn other words, you\u2019re just supposed to know that you have to fill out this form.<br \/>\nAnd if you don\u2019t, the penalties are severe.<br \/>\nFor the first time ever the government is imposing both civil and CRIMINAL penalties for non-compliance.<br \/>\nThe fine for not filling out the survey (known as BE-10) ranges from $2,500 all the way to $25,000.<br \/>\nAnd if they think you intentionally didn\u2019t file, you \u201cmay be imprisoned for not more than one year.\u201d<br \/>\nEither way, even if you had no earthly idea and had never heard of this survey, they reserve the right to seek \u201cinjunctive relief commanding such person to comply.\u201d<br \/>\nSo if you don\u2019t fill out the form, they\u2019ll get a judge to order you to comply.<br \/>\nThis really borders on insanity.<br \/>\nThe federal government of the United States of America\u2026 the Land of the Free&#8230; is willing to clog up the court system to either force people to fill out a survey, or to prosecute them for not doing so.<br \/>\nForget about rapists, murderers, and thieves. The government\u2019s priority is to imprison people who don\u2019t fill out surveys.<br \/>\nWhat\u2019s really amazing is that your elected representatives in Congress weren\u2019t the ones to enact these absurd criminal penalties.<br \/>\nThe Department of Commerce\u2019s Bureau of Economic Analysis (BEA) did this all on its own. They simply created a new \u2018rule\u2019, then buried it under hundreds of pages of other regulations.<br \/>\nAnd even though Congress never even sees them, and no reasonable person has ever heard of them, these rules have the same weight and effect as the law.<br \/>\nSo much for representative democracy.<br \/>\nTwo important questions come to mind:<br \/>\n1) How many other rules that carry criminal penalties might we be breaking at this very moment without even realizing it?<br \/>\n2) Just who the hell do these people think they are?<br \/>\nRegardless of whether or not the penalties are ever exacted is irrelevant.<br \/>\nIt\u2019s disgusting to even be threatened with such atrocity, simply because some bureaucratic functionary needs to justify his\/her position.<br \/>\nIt\u2019s a clear sign that in today\u2019s system, the government doesn\u2019t exist to serve the people. They think the people exist to support the government.<br \/>\nAbraham Lincoln once told a war-torn nation that a government of the people, by the people, for the people, shall not perish from this earth.<br \/>\nTragically, Lincoln was totally wrong. Because this is what freedom has become in America.<br \/>\nHave you reached your breaking point yet?<br \/>\nPS:<br \/>\nI\u2019ll publish more about form BE-10 soon. The quick and dirty is this: you need to file if you are a US individual or company that owned at least 10% of a foreign business at any time during your 2014 fiscal year (January 1 \u2013 December 31 for most folks.)<br \/>\nIf you\u2019re an individual, the reporting requirements are very simple&#8211; just a few boxes to check. It might take you five minutes&#8230; which makes being threatened with criminal penalties even more ridiculous.<br \/>\nThey just extended the deadline from May 30th.\u00a0 The deadline to submit for first-time filers is June 30, 2015, and you can submit via mail, fax, or online.
